UK's Bold New Tobacco Bill progresses

 


The UK government has unveiled one of the most ambitious public health initiatives in decades: the Tobacco and Vapes Bill, designed to phase out smoking and curb youth vaping. Here’s what you need to know:

Generational Tobacco Ban

  • Anyone born on or after 1 January 2009 will never be legally sold tobacco.

  • The age-of-sale increases by one year every year, creating a permanent generational ban.

  • Possibly the weakest part of the bill as confusing - who would know of an 18 or 19, or 28 and 29 verification. Why not simply specify hikes to 21 and 25? Few new smokers after 25?

  • NHS Prescription for over 30s Tobacco/Vape: £5 for 2 years with Smoking Cessation

Vaping Restrictions

  • All vapes, including non-nicotine products, are banned for under-18s.

  • Proxy purchasing—adults buying vapes for minors—is now illegal.

  • Free samples and vending machines for vapes are prohibited.

  • Solid change given rise in teen vapers and new disposable vape ban: vapes as Smoking Cessation only. Extra curbs on kiddy flavours?

Retail Licensing and Enforcement

  • Retailers must obtain a license to sell tobacco, vapes, or nicotine products.

  • Fixed Penalty Notices of up to £200 for underage sales; £2,500 for licensing breaches.

  • Trading Standards Officers empowered to enforce rules on the spot.

  • The most important change: council review for stores and smoking products sold - even a tax top slice of supermarket tobacco sales as Tobacco sunsets? Prescription only after 2035?

Packaging and Advertising

  • Advertising and sponsorship of vapes and nicotine products is banned.

  • Flavours, packaging, and point-of-sale displays must not appeal to children.

  • Cigarettes must be sold in original packaging—no splitting or loose sales.

  • Solid but extend POS to none on display as with existing Tobacco cupboards plus bongs, Rizla, lighters etc.

Smoke-Free and Vape-Free Zones

  • Smoking and vaping banned in children’s playgrounds, school grounds, and hospital entrances.

  • Public consultations will determine further outdoor restrictions.

  • Solid but France lead with Beach and Parks ban.

Public Health and Economic Impact

  • Smoking causes 80,000 UK deaths annually, and 5M globally, and costs the UK £21.8 billion per year.

  • The Bill aims to reduce health inequalities, especially in deprived areas.

  • Pack inserts will offer quitting advice and positive messaging.

  • Solid and store locations/product range key.

Industry and Innovation

  • Manufacturers must register products before sale.

  • Future tech may include age-verification chips in vapes to prevent underage use.

  • A proposed “polluter pays” levy could raise £700 million annually for cessation services.

  • Solid with surge in snus and tobacco pouches and kiddy flavours.
